Terms of Service

Welcome to Luxion Elite LLC (“Luxion Elite,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, luxionelite.com (the “Site”), and any vehicle rental, delivery, or related services we provide in Los Angeles County and Orange County, California (collectively, the “Services”). By accessing the Site or booking a Service, you agree to these Terms. If you do not agree, please do not use the Site or our Services.

 

1. Eligibility

To reserve or rent a vehicle from Luxion Elite, you must:

  • Be at least 25 years of age (drivers under 25 may be accepted at our discretion, subject to additional fees or restrictions);
  • Hold a valid, unexpired driver’s license;
  • Provide a valid major credit card in your own name for payment and security deposit purposes; and
  • Provide proof of personal auto insurance and/or meet our minimum coverage requirements, as applicable.

We reserve the right to refuse service to anyone who does not meet these requirements or who we reasonably believe poses a safety or financial risk.

 

2. Reservations & Booking

Reservations made through the Site are requests, not confirmed bookings, until you receive written confirmation from Luxion Elite. Prices displayed on the Site are per-day rates and are subject to change until a reservation is confirmed. Additional fees may apply for delivery, additional mileage, additional drivers, and add-on services.

 

3. The Rental Agreement

These Terms describe your use of our website and the general framework of our Services. Your actual rental — including the specific vehicle, rental period, mileage allowance, security deposit, insurance requirements, and damage liability — is governed by a separate Rental Agreement that you will review and sign (electronically or in person) at the time of delivery or pickup. In the event of a conflict between these Terms and your signed Rental Agreement, the Rental Agreement controls for that specific transaction.

 

4. Pricing & Payment

  • All rates are quoted in U.S. Dollars and are subject to applicable taxes and fees.
  • Full or partial payment, plus a refundable security deposit, is due prior to or at the time of vehicle delivery/pickup, as specified in your Rental Agreement.
  • We accept major credit cards. A valid credit card must remain on file for the duration of the rental to cover tolls, citations, fuel charges, and any damage assessed after return.

5. Cancellations & Refunds

  • Reservations cancelled more than 72 hours before the scheduled start time are eligible for a full refund of any deposit paid.
  • Reservations cancelled within 72 hours of the scheduled start time may be subject to a cancellation fee of up to one (1) day’s rental rate.
  • No-shows and same-day cancellations are non-refundable.
  • Luxion Elite reserves the right to cancel or reschedule a reservation due to vehicle unavailability, safety concerns, or circumstances beyond our control (see Section 13, Force Majeure), in which case you will receive a full refund or the option to rebook.

6. Security Deposit

A refundable security deposit is required for every rental and will be held on your credit card. The deposit will be released within a reasonable period after the vehicle is returned in its original condition, less any charges for damage, excess mileage, fuel, tolls, citations, or violations of these Terms or your Rental Agreement.

 

7. Vehicle Use Restrictions

Unless otherwise agreed in writing, you agree that the vehicle will not be used:

  • By anyone other than the authorized renter(s) listed on the Rental Agreement;
  • For racing, track use, off-roading, or any competitive driving event;
  • Outside of Los Angeles and Orange County, California (or other geographic limits specified in your Rental Agreement) without prior written approval;
  • To tow or push another vehicle;
  • To transport passengers or cargo for hire (e.g., rideshare or delivery services);
  • While under the influence of alcohol or drugs;
  • For any illegal purpose; or
  • In a manner that violates any applicable federal, state, or local law.

Violation of these restrictions may result in immediate termination of the rental, forfeiture of the security deposit, and liability for any resulting damage, fines, or legal costs.

 

8. Insurance & Liability for Damage

You are responsible for the vehicle from the time of delivery/pickup until it is returned to and inspected by Luxion Elite. You will be held financially responsible, up to the full value of the vehicle, for any damage, loss, or theft that occurs during the rental period, except to the extent covered by insurance or a damage waiver purchased as part of your Rental Agreement. Specific deductibles, coverage limits, and damage waiver options will be detailed in your Rental Agreement.

 

9. Traffic Violations, Tolls & Citations

You are responsible for all traffic citations, parking violations, toll charges, and related administrative fees incurred during your rental period. These amounts, plus any applicable processing fee, will be charged to the credit card on file.

 

10. Fuel Policy

Vehicles are delivered with a specific fuel level noted on your Rental Agreement and must be returned with the same fuel level. Vehicles returned with less fuel will be charged a refueling fee plus the cost of fuel.

 

11. Delivery & Pickup

Luxion Elite offers concierge delivery and pickup within our standard service area (Los Angeles and Orange County). Delivery to airports, hotels, and other locations may be subject to additional fees. You are responsible for being available at the agreed time and location; excessive wait times or failure to appear may result in additional charges or cancellation of the reservation.

 

12. Website Use

You agree to use the Site only for lawful purposes and agree not to:

  • Attempt to gain unauthorized access to the Site or its systems;
  • Use any automated system (bots, scrapers) to access the Site without our written permission;
  • Interfere with the proper functioning of the Site; or
  • Submit false or misleading information in any form on the Site.

13. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, and vehicle imagery — is the property of Luxion Elite LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

 

14. Third-Party Links

The Site may contain links to third-party websites (such as our social media pages) that are not owned or controlled by Luxion Elite. We are not responsible for the content, privacy policies, or practices of any third-party sites.

 

15. Disclaimer of Warranties

The Site and Services are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law.

 

16. Limitation of Liability

To the fullest extent permitted by law, Luxion Elite LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Services, including but not limited to loss of use, loss of data, or personal injury, except where such limitation is prohibited by law.

 

17. Indemnification

You agree to indemnify and hold harmless Luxion Elite LLC, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the vehicle, violation of these Terms, or violation of any law or third-party right.

 

18. Force Majeure
